The MLMA reviews bidding documents to assure that the proper and current wage schedules are listed, and if it is a state funded project that proper reference is made in giving Montana contractors and Montana Residents preference when it comes to awarding the project and manning the project.

MLMA compliance investigators visit construction sites and conduct interviews with the workers to confirm that all the contractors on the project are in compliance in paying the prevailed wage. If the workers are not receiving the prevailed wage, and the contractor refuses to comply, we encourage them to file a prevailing wage complaint. If the employees are unwilling to file a complaint, we will ask the enforcing agency to conduct a prevailing wage audit.

The MLMA also educates the awarding agencies and their agents of the importance of including the proper prevailed wages in the bidding documents. Upon request the MLMA will assist your organization in getting the current prevailed wages for your project, or help you find the answers to any other questions concerning prevailed wage issues.

When a worker files an official wage complaint, they will have to be named in the complaint. Many times we can convince a contractor to voluntarily pay back wages for all that were misclassified without bringing any individuals name to light as the one complaining. In most cases we get back wages paid by the contractor without an official complaint being filed.
